Use of the account states acceptance of the privacy as well as terms
and use documents.  You cannot sue someone when you disagree with
something you didn't bother to read, but agreed to.  If they are in
fact doing something more than they indicate in those two policies, OR
did not offer you an alternative (don't use Google Services), then they
could be liable, but I don't hear any accusations that they are doing
anything of the sort.

(Why do I feel like I've just been under the bridge feeding a troll :)
