Glad you found a work-around. That said, i'm not sure you read that
paragraph regarding "clear behavior" and applied it towards your
experience correctly. This taken in light of a spyware/adware/malicious
application or shady software context, I think it is their way of
saying if a change occurs to the expected behavior of your computer
after installing an app, you should know which app caused that change.
(Consider this in light of something mysteriously changing your home
page, search results being hijacked, extra unwanted toolbars, popup ads
from nowhere - as a result of installing some application).

I've used the sidebar extensively, and I think all but the most
unsophisticated user would be confused as to why desktop items shift
over when the sidebar is maximized or resized. Make no doubt about it,
the sidebar *changes* your user experience in many ways. The passage
you've quoted simply indicates that this change not be clandestine. And
to be sure, it appears they'd still be within their principles if they
didn't make "stay on top of other windows" feature disable-able.
(Although we're on the same page that this ability is good).
